Register FIR against SHO, 4 PSOs: Court

JAMMU: Special Municipal Mobile Magistrate, VS Bhou on Thursday directed Senior Superintendent of Police ( SSP) Jammu to register First Information report ( FIR) against Station House Officer ( SHO) of Police Station Trikuta Nagar and four PSOs.
This Court direction was passed in a complaint filed by Nawdeep Sharma of Sainik Colony against SHO Trikuta Nagar Sameer Jeelani and other four accused PSOs.
In the complaint it was submitted that on 21st August at about 12:30 pm while complainant was  withdrawing money from the PNB ATM at Bahu Plaza Jammu along with his cousin, the accused SHO started using abusive and unparliamentarily language against the complainant and also misbehaved in public place in-front of many people.

It was complained that the SHO Police Station Trikuta Nagar also slapped and beat complainant without any reason. Meanwhile, PSOs of SHO and the constables also joined and started beating and thrashing the complainant mercilessly .
On smelling the situation and looking at the people gathering on spot, the complainant alleged that the SHO along with others police officials took him to Police Station where he was further subjected to thrashing and harassment with sticks, iron-rods etc with choicest abuses .
It is further submitted that during the period of detention, the complainant was threatened by all police officials not to utter a single word about the whole episode and if at all he chose to disclose the same to any one, he will be implicated in frivolous cases and even he will be eliminated.
After the intervention of local public and relatives of the complainant and realising the deteriorating condition of the complainant because of the regular beating inflicted on him, the SHO released the complainant after two hours of illegal detention.
The complainant was taken to Govt Hospital Gandhi Nagar Jammu for treatment where the MLC case was registered. The complainant prayed before the Court to pass the directions to SSP Jammu to conduct an investigation in respect of the allegations levelled against the SHO and others and also sought direction to CMO Govt Hospital Gandhi Nagar Jammu to produce the medical record of the complainant in the Court.
After hearing Advocate JP Nanda appearing for the petitioner, the Special Municipal Mobile Magistrate Jammu perused allegations which are serious in nature . He forwarded the complaint to SSP Jammu to register FIR against the accused because cognizable case is made out against them and further directed for investigation into the matter expeditiously under law.
The Court directed that periodical reports of investigation be communicated to this Court by SSP Jammu and first action taken report be filed on September 12, 2012.
